HOW IT WORKS.
- You, a NXT Level designee, will receive one (1) electronic and one (1) set of four (4) printed referral cards. Additional printed cards can be distributed to designees upon request.
- Fill in your name and share the card(s) with colleagues you would like to refer to the NXT Level 1 training (via email to as many individuals as you would like or by providing individuals with a printed referral card).
- Each time a referred person completes a NXT Level 1 in its entirety on or before June 30, 2020—and your full name is listed as the referrer on their training application—you will be eligible for up to six (6) rewards, as follows:
- One (1) completed training = one (1) travel mug
- Two (2) completed trainings = one (1) NXT Level hooded sweatshirt
- Four (4) completed trainings = one (1) $50.00 Amazon gift card
- Rewards will be mailed to you within thirty (30) days after referred person completes the NXT Level 1 training.
PROGRAM TERMS OF USE.
Northwest Energy Efficiency Alliance, Inc. (“NEEA”) is offering you the opportunity to make Qualified Referrals to the NXT Level 1 training via a referral program (“Program”) offered to NXT Level 1 designees through email and direct mail.
BINDING AGREEMENT.
By participating in the Program, you are bound by these Terms and Conditions (“Terms”) and indicate your agreement to them. All of the NEEA’s decisions are final and binding.
PRIVACY.
The personal information collected, processed and used as part of the Program will be used in accordance with NEEA’s Privacy Policy, which is available at: http://neea.org/privacy-and-terms-of-service.
PROGRAM AND ELIGIBILITY.
Users who refer are called “Referrers”. Individuals who receive a referral are called “Referred Customers”. To participate, Referrers must follow the referral instructions listed in the “HOW IT WORKS” section above. To be “eligible”, a Referrer must: 1) be a legal resident of the United States of America, and 2) be at least eighteen (18) years old. Employees of NEEA, its funders or any of its affiliates or promotional agencies are not eligible.
QUALIFIED REFERRALS.
“Qualified Referral” means that all the following conditions are met: 1) The Referred Customer has not previously completed a NXT Level 1 application; 2) The Referred Customer is a) a legal resident of the United State of America and resides in Idaho, Montana, Oregon, or Washington and b) at least eighteen (18) years old at the time of referral; 3) the Referred Customer has completed the NXT Level 1 Training in its entirely by June 30, 2020; and 4) the Referred Customer lists the Referrer’s name on their NXT Level 1 training application.
REWARDS.
For each Qualified Referral, Referrers will be eligible for the following Rewards:
- One (1) Qualified Referral = one (1) travel mug
- Two (2) Qualified Referrals = one (1) NXT Level hooded sweatshirt
- Four (4) Qualified Referrals = one (1) $50.00 Amazon gift card
A Referrer cannot earn more than two (2) of each type of Reward, and a Referrer cannot earn more than six (6) Rewards in total. Any Rewards earned by the Referrer will be mailed to the address provided by Referrer to NEEA within thirty (30) days after Referred Customer completes the NXT Level 1 training. NEEA may delay a Reward for the purposes of investigation. NEEA may also refuse to verify and process any transaction NEEA deems, in its sole discretion, to be fraudulent, suspicious, in violation of these Terms and Conditions, or believes will impose potential liability on NEEA, its funders, affiliates or any of their respective officers, directors, employees, representatives and agents. All of the NEEA’s decisions are final and binding, including decisions as to whether a Qualified Referral or Reward is verified.
RESTRICTIONS.
Referrers cannot refer themselves or submit duplicate, fictitious or fake Referrals with the NEEA. No Referrer may use the Program to violate any law, infringe or violate the rights of any third party, or otherwise act in a manner that is deemed harassing, harmful, illegal, hateful, obscene or outside the spirit and intent of the Program. A Referrer cannot earn more than two (2) of each type of Reward, and a Referrer cannot earn more than six (6) Rewards in total. Rewards may not be redeemed for cash. Rewards are not transferrable and may not be auctioned, traded, bartered or sold. In addition, you may not (i) tamper with the Program, (ii) act in an unfair or disruptive manner, or (iii) use any system, bot or other device or artifice to participate or receive any benefit in the Program. Employees of the NEEA or any of its or their subsidiaries, affiliates or promotional agencies are not able to participate.
LIABILITY.
YOU UNDERSTAND AND AGREE THAT THE RELEASED PARTIES (DEFINED BELOW) SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF THE NEEA WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES). By participating in the Program, you agree to defend, indemnify, release and hold harmless the NEEA and its funders, affiliates and subsidiaries, together with their respective employees, directors, officers, licensees, licensors, shareholders, attorneys and agents including, without limitation, their respective advertising and promotion entities and any person or entity associated with the production, operation or administration of the Program (collectively, the “Released Parties”), from any and all claims, actions, demands, damages, losses, liabilities, costs or expenses caused by, arising out of, in connection with, or related to the Program (including, without limitation, any property loss, damage, personal injury or death caused to any person(s)) and/or the awarding, receipt and/or use or misuse of any benefit in the Program. To be clear, the Released Parties shall not be liable for any technical errors or malfunctions, data theft or corruption, any printing or typographical error, or any damage to any computer system resulting from participating in, or accessing or downloading information in connection with the Program. The Released Parties shall not be liable to any users for failure to supply any advertised benefit, by reason of any acts of God, any action or request by any governmental or quasi-governmental entity (whether or not valid), or any other activity or action that is beyond any of the Released Parties’ control.
DISCLAIMER OF WARRANTIES.
YOU EXPRESSLY UNDERSTAND AND AGREE THAT: (A) THE PROGRAM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS AND THE NEEA EXPRESSLY DISCLAIMS ALL WARRANTIES, CONDITIONS AND TERMS OF ANY KIND, WHETHER EXPRESS OR IMPLIED BY STATUTE, COMMON LAW OR CUSTOM, INCLUDING, BUT NOT LIMITED TO, WARRANTIES AS TO PRODUCTS OR SERVICES OFFERED THROUGH THE USE OF THE PROGRAM, IMPLIED WARRANTIES OF MERCHANTABILITY, SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT; (B) THE RELEASED PARTIES MAKE AND GIVE NO WARRANTY THAT (i) THE PROGRAM WILL MEET YOUR REQUIREMENTS, (ii) THE PROGRAM WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, AND (iii) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED BY YOU THROUGH THE PROGRAM WILL MEET YOUR EXPECTATIONS, AND (C) ANY MATERIAL DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE PROGRAM IS ACCESSED AT YOUR OWN DISCRETION AND RISK, AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR MOBILE DEVICE OR LOSS OF DATA THAT RESULTS FROM THE DOWNLOAD OR USE OF ANY SUCH MATERIAL.
BULK DISTRIBUTION (“SPAM”).
Each Referrer must be the actual sender of the referral emails or the provider of the printed copies of the referral cards and must comply with all applicable laws. Referral solicitations must be created and distributed in a personal manner that is appropriate and customary for communications with friends, colleagues and family members. Referrers who do not comply with applicable laws, including any anti-spam laws, are obligated to indemnify the Released Parties against any liabilities, costs and expenses incurred as a result of such spam. Bulk email distribution, distribution to individuals that are unknown to Referrer, or any other use of the materials described herein in a manner inconsistent with these Terms is expressly prohibited and may be grounds for immediate termination and further legal action.
MISCELLANEOUS.
All claims arising out of this Program or these Terms and disputes not settled between the parties shall be settled by binding arbitration in accordance with the then effective rules of the Arbitration Service of Portland, Inc. Any arbitration hearing will be held in Portland, OR. Subject to the Arbitration provisions of these Terms, the parties irrevocably submit to the exclusive jurisdiction of the Multnomah County Circuit Court or the United States District Court in Portland, Oregon, over any suit, action or proceeding arising out of or relating to this Program or these Terms, and confirm that such court shall have personal jurisdiction over the parties.
NEEA reserves the right to cancel, modify or terminate the Program at any time for any reason in its sole discretion. NEEA reserves the right to disqualify any Referrer at any time from participation in the Program if she/he does not comply with any of these Terms.
